Let me give you the realistic picture (I'm a 2015 EB2 filer, still waiting): **Current state**: EB2 India is moving about 2-3 months per year. At this rate, March 2022 priority date = ~30+ year wait. Yes, it's absurd. **Possible relief**: - **Eagle Act / AAPI Act**: Country cap elimination bills introduced every Congress since 2019. They have bipartisan support but keep getting stalled. Don't count on it. - **Visa recapture**: 200K+ unused family visas from COVID years could be recaptured for EB categories. Currently in discussion. - **EB-5 reallocation**: Unused EB-5 visas sometimes spill over to EB2/EB3. Helped a bit in 2023. **What to actually do**: 1. **File EB1-A or EB1-B** if you qualify — no backlog, current for India 2. **EB2-NIW** self-petition — same backlog but no employer dependency 3. **Canada PR** as backup (Express Entry, 6 months). You can work in the US and have Canadian PR as insurance 4. **Explore EB-5 investor visa** if you have $800K+ Don't put your life on hold for a green card. Make decisions based on what's best for your family NOW.
I was EB2 India 2016 filer. Switched to EB1-A last year and got approved in 5 months, green card in hand. If you have ANY publications, patents, awards, media coverage, or evidence of being at the top of your field — talk to an EB1-A lawyer. The bar is high but not impossible, especially for senior engineers and researchers.
